A Capacity Overview

We explain capacity to clients on an almost daily basis. It underlies so much of our health care system when it comes to medical decision-making. A patient must be "capable" of making their own treatment decisions, otherwise someone else (usually a relative) decides for them. Each type of capacity is subject to its own rules about the threshold and who gets to decide if a person is capable. In this video we provide an overview of what the legal concept of capacity in Ontario is all about.
