We explain capacity to clients on an almost daily basis. It underlies so much of our health care system when it comes to medical decision-making. A patient must be "capable" of making their own treatment decisions, otherwise someone else (usually a relative) decides for them. But the concept of capacity is very confusing, particularly because there are many types of capacity. Each type of capacity is subject to its own rules about the threshold and who gets to decide if a person is capable. In this video we provide an overview of what the legal concept of capacity in Ontario is all about.
